Terms of Service

This is a draft prepared for DrainReport and has not yet been reviewed by a solicitor. Do not treat it as final legal advice or a binding policy until it has been reviewed.

These Terms of Service ("Terms") govern your access to and use of DrainReport's website and CCTV drain survey reporting platform (the "Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the organisation you represent.

1. The Service

DrainReport allows you to upload CCTV drain survey footage, receive AI-generated MSCC-coded observations and pipe data, review and approve those observations, and generate WRC-format PDF survey reports.

2. Accounts and organisations

You must provide accurate information when creating an account. Each organisation account is responsible for the actions of its users, and for ensuring users hold any certifications (such as MSCC certification) required for the reports they produce and approve.

3. AI-generated content and your responsibility

DrainReport's AI analysis is provided as a starting point to speed up report production. It is your responsibility, as a certified surveyor or reviewer, to check, amend, and approve AI-generated observations before a report is issued to a client. DrainReport does not guarantee that AI output is complete, accurate, or fit for any particular purpose without your review.

4. Acceptable use

  • You will only upload footage you have the right to upload and process.
  • You will not use the Service to store or process content that is unlawful, infringing, or that you do not have permission to use.
  • You will not attempt to reverse engineer, disrupt, or gain unauthorised access to the Service.

5. Subscriptions and fees

Where the Service is offered on a subscription or credit basis, pricing and billing terms will be presented to you at sign-up or in your account settings. We may change pricing on notice for future billing periods.

6. Intellectual property

You retain ownership of the footage, job data, and reports you create using the Service. DrainReport retains ownership of the Service itself, including its software, AI models, and underlying technology. We may use de-identified or aggregated data derived from your use of the Service to improve our AI models.

7. Availability and changes

We aim to keep the Service available and to give notice of planned maintenance where practical, but we do not guarantee uninterrupted availability. We may update or change features of the Service over time.

8. Limitation of liability

To the maximum extent permitted by law, DrainReport is not liable for indirect or consequential losses arising from your use of the Service, including losses arising from reliance on AI-generated observations that were not reviewed and approved in accordance with these Terms.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate accounts that breach these Terms or applicable law.

10. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
